Terms of Service – Nihongo Nepal

Welcome to Nihongo Nepal (“the App”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your use of the Nihongo Nepal mobile application and related services.

By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. About Nihongo Nepal

Nihongo Nepal is a Japanese language learning platform aimed to facilitate language institute based in Nepal to help their students leverage mobile app for language learning and exam preparation. The platform provides educational content including lessons, flashcards, quizzes, examinations, conversation practice, downloadable learning materials, and institute management tools.

2. Eligibility

You may use Nihongo Nepal if:

  • you are legally able to enter into this agreement; or
  • you are using the App under the supervision of a parent, guardian, school, or language institute.

If your account is provided by a language institute, the institute may manage your enrollment and access to courses.

3. Your Account

Your account is identified using your mobile phone number.

Accounts are generally created or managed through participating language institutes.

You are responsible for:

  • keeping your phone number secure;
  • maintaining access to your device;
  • keeping your OTP confidential.

You agree not to allow another person to use your account.

4. Educational Use

Nihongo Nepal is intended solely for educational purposes.

You agree not to:

  • copy lessons or videos;
  • redistribute downloadable content;
  • reverse engineer the application;
  • attempt unauthorized access to the platform;
  • use the App for unlawful purposes.

5. Intellectual Property

All educational content, including but not limited to:

  • videos
  • audio
  • flashcards
  • illustrations
  • quizzes
  • lesson structures
  • application design
  • software

is owned by the creator of the app OR the language teaching institute administering the app and is protected by copyright and other intellectual property laws.

Downloading content for offline learning does not transfer ownership or grant redistribution rights.

6. Institute Managed Accounts

If you access Nihongo Nepal through a language institute:

  • your institute may assign lessons and examinations;
  • instructors may view your learning progress;
  • instructors may view examination results;
  • your institute may suspend or revoke your access.

Questions regarding enrollment should be directed to your institute.

7. Conversation Practice

Conversation Practice uses your device’s built-in speech recognition service.

Nihongo Nepal does not record or permanently store your voice recordings.

Speech recognition accuracy depends on your device, operating system, internet connection (where applicable), and the underlying speech recognition provider.

We do not guarantee perfect recognition.

8. Offline Downloads

Downloaded lessons are licensed solely for your personal educational use.

You may not:

  • extract videos;
  • share downloaded files;
  • distribute lesson materials;
  • circumvent encryption or digital protections.

9. Availability

We strive to keep the service available at all times.

However, we do not guarantee uninterrupted operation.

Services may be unavailable due to:

  • maintenance;
  • software updates;
  • internet outages;
  • third-party service interruptions.

10. Changes to the Service

We may:

  • add features;
  • remove features;
  • update lesson content;
  • improve functionality.

These changes may occur without prior notice.

11. Account Suspension

We may suspend or terminate access if:

  • these Terms are violated;
  • illegal activity is detected;
  • fraudulent behavior occurs;
  • misuse of the platform is identified.

Where appropriate, institute administrators may also revoke learner access.

You may request deletion of your account at any time.

12. Account Deletion

If your account is managed through a language institute, deletion may also remove your enrollment and learning history.

Requests must be submitted to the institute OR may be submitted by contacting support.

13. Disclaimer

Nihongo Nepal is provided “as is.”

Although we make every effort to ensure accurate educational content, we do not guarantee that the service will always be error-free or uninterrupted.

Learning outcomes depend on the learner’s own effort and practice.

14. Limitation of Liability

To the maximum extent permitted by law, Progressive Labs Pvt. Ltd. shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the App.

Our total liability shall not exceed the amount paid by you for use of the App during the twelve months preceding the claim.

15. Privacy

Your use of Nihongo Nepal is also governed by our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time.

The “Last Updated” date will indicate the latest revision.

Continued use of the App constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by the laws of Nepal unless otherwise required by applicable consumer protection laws.
